Where do I complain  [20/2/2007 18:55:51]

OK.

Who do I complain to, Ofcom, ICSTS or DMA.

I am getting a phone call every evening for the past few months from the same company. They are asking for a previous owner of the house. Every time they are told that they are not here any more and to stop calling. My hone number is registered with TPS. Also the caller is always with holding the number.

Now surely as I am TPS I should not e getting the call. Also aren't all companines now supposed to have some number to get back to rather than witheld.

SO if soebody can tell me who to go to next would be much apreciated.

BTW the company that is calling states they are called Consumer Lifestyle, sounds like they are operating out of India (no disrespect to the good companies)

It's OFCOM, if you consider it's persistent misuse. This is where the ideas of having a CLI to return calls on comes from.

OFCOM are also responsible for the TPS if I remember correctly, although they've outsourced the day-to-day list administration.

However, if they've got legitimate reason to believe that they've got permission to call (ie, the previous owner has given their permission) then they don't have to bother with the TPS list.

Your best bet is to write to them and tell them that he no longer lives their and you expressly forbid them to call you. Then if they continue you'll have scope to complain that they don't have permission and have ignored both your requests to be left alone (on TPS and your letter).

However, as you will be aware, the chances are that there's no company called consumer lifestyle. In this instance you might want to try asking BT for a trace, but getting this activated is a painful process.

Paul,

This is the grey area bit!

Consumer Lifestyles is actually a reputable
survey data collection company in the UK, diallin
from the UK.

I've used them in the past for targeted dialling lists.

Normally if you ask they'll remove you quite happily,
however, I'm fairly certain a survey call isn't covered
by the TPS rules given it's not actually a marketing (sale)
call.

As I said they should remove you without a problem, if
not I'd suspect someone trading off their name.

Rule 1: If it is CL they shouldn't be trying to sell you
anything, it's not what they do.

From my experience, if you are registered with TPS and continue to get 'nuisance' calls, you can request a complaint form to ask TPS to take it up with the company involved.

You will need details like time/date of the calls, who you spoke to, and what they were trying to achieve from the call (selling windows etc)

One thing i'm not sure of is how TPS feedback their progress of the complaint but its a start.
